Terms of Service

These Terms of Service ("Terms") govern access to and use of Opeyra Connect (the "Service"), provided by Mystery Info Solutions ("Opeyra," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms on behalf of yourself or the business you represent ("Customer," "you").

1. The Service

Opeyra Connect is a customer relationship management tool that connects to a Customer's own WhatsApp Business Account and lets the Customer's team send and receive WhatsApp messages, manage contacts, and collaborate on conversations through a shared inbox.

2. Eligibility and accounts

You must be authorized to act on behalf of the business you register, and you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Your responsibilities

As a Customer using the Service, you agree that you will:

• Comply with Meta's WhatsApp Business Messaging Policy and all applicable WhatsApp Business Platform terms
• Obtain any consent required by law before messaging your End Users over WhatsApp
• Not use the Service to send unsolicited, deceptive, or unlawful messages, including spam
• Not use the Service in a way that infringes the rights of others or violates applicable law
• Keep your account credentials secure and promptly notify us of any unauthorized use

We may suspend or terminate accounts that violate these responsibilities, particularly where violations put our WhatsApp Business Platform access at risk.

4. Dependence on the WhatsApp Business Platform

The Service relies on Meta's WhatsApp Business Platform to send and receive messages. Message delivery, template approval, and account status are subject to Meta's own policies and availability, which are outside our control. We are not responsible for service interruptions caused by changes to, or outages of, the WhatsApp Business Platform.

5. Fees

Any fees for the Service will be set out in your order form, invoice, or as otherwise agreed with you in writing. WhatsApp conversation-based pricing charged by Meta is separate from, and in addition to, any fees charged by Opeyra, unless stated otherwise.

6. Data and privacy

Our collection and use of information in connection with the Service is described in ourPrivacy Policy, which forms part of these Terms. As between you and us, you retain ownership of the conversation data and content generated by your use of the Service.

7. Intellectual property

We retain all rights, title, and interest in and to the Service, including its software, design, and branding. These Terms do not grant you any rights to our trademarks or branding except as necessary to use the Service as intended.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by Meta's platform policies, or if we discontinue the Service, with notice where reasonably practicable. Upon termination, your right to use the Service ends, subject to our data retention and deletion practices described in theData Deletion Instructions.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Opeyra and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the Service.

11. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts located in India.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
